3.2 Suppliers, Freelancers and Subcontractors

When working with suppliers, technicians, freelancers, camera operators, editors and other subcontractors, we may process:

  • Professional identification and contact details.
  • Company and invoicing information.
  • Bank account details necessary for payments.
  • Contractual arrangements and work assignments.
  • Availability and project coordination information.
  • Professional qualifications where relevant to the assignment.

We limit the information collected to what is reasonably necessary for the relevant business relationship.

3.3 Event Photography, Filming and Video Production

When providing audiovisual services, we may process:

  • Photographs and video recordings in which individuals are identifiable.
  • Audio recordings, including speeches, presentations and interviews.
  • Names, professional titles and spoken contributions where relevant.
  • Event information, including dates, locations and programme details.
  • Information necessary to edit, deliver, store, archive or publish audiovisual material.

Recordings may include speakers, performers, employees, guests, visitors and other event participants.

We do not intentionally seek to collect special-category personal data through ordinary event filming. However, sensitive information may incidentally appear in recordings. Where the processing of special-category data is relevant, an applicable legal basis and any additional conditions required by law must be established.

3.4 Website Visitors

Depending on the final technical configuration of our website and the services integrated into it, we may process:

  • IP addresses and technical connection information.
  • Browser, device and operating system information.
  • Pages visited and website usage information.
  • Cookie preferences and similar technical identifiers.
  • Information submitted through contact forms or other website functions.

The specific information collected depends on the website configuration, hosting provider and integrated services.

4. Purposes and Legal Bases for Processing

We process personal data only where a lawful basis under Article 6 GDPR applies.

4.1 Contractual Services

We process personal data to:

  • Respond to enquiries and prepare quotations.
  • Negotiate and conclude agreements.
  • Provide equipment rental and technical production services.
  • Plan and execute event production and video assignments.
  • Coordinate deliveries, schedules, personnel and subcontractors.
  • Edit and deliver audiovisual materials.
  • Manage payments and contractual communications.

Legal basis: Performance of a contract or taking steps at your request before entering into a contract.

4.2 Legal and Accounting Obligations

We process relevant business and financial information to comply with applicable tax, accounting and other legal obligations.

Legal basis: Compliance with a legal obligation.

4.3 Legitimate Business Interests

Where appropriate, we may process personal data for legitimate business interests, including:

  • Managing professional relationships with clients, agencies and suppliers.
  • Maintaining relevant business and project records.
  • Coordinating projects and ensuring service quality.
  • Protecting our equipment, systems and business operations.
  • Establishing, exercising or defending legal claims.
  • Maintaining a professional portfolio and promoting our services through selected project references, where legally permitted.

We rely on legitimate interests only where the processing is necessary and our interests do not override the rights and freedoms of the individuals concerned.

Where required, we assess and document the balance between our interests and the impact on the individuals concerned.

Individuals may object to processing based on legitimate interests. We assess such objections in accordance with applicable law.

4.4 Marketing Communications

We may communicate with relevant business contacts about our services, projects and activities where permitted by applicable law.

Where prior consent is legally required, we will obtain it before sending the relevant communications.

You may object to direct marketing at any time. Following an objection, we will stop processing your personal data for direct marketing purposes.

5. Event Photography, Filming and Portfolio Use

We provide technical production and audiovisual services for conferences, corporate events, exhibitions, performances, parties and other events.

Our work may involve general event recordings, presentations, performances, interviews, promotional videos and other audiovisual content commissioned by clients or event organisers.

5.1 Recordings Commissioned by Clients or Agencies

Where a client, agency or event organiser commissions a recording, the permitted purposes and intended use of the material depend on the project agreement and applicable law.

Depending on the actual arrangements, we may act as:

  • A data processor, processing personal data on behalf of a client in accordance with documented instructions; or
  • An independent data controller, where we determine the purposes and means of our own processing.

Where we act as a data processor, we process personal data in accordance with the client’s documented instructions and the applicable data processing agreement.

Where we independently determine the purposes and means of processing, including the use of recordings in our own portfolio, we are responsible for establishing an appropriate legal basis.

The parties’ actual activities determine their roles under the GDPR. A contractual label alone does not determine whether a party is a controller or processor.

A client’s permission to film an event does not automatically establish every legal basis required for recording or publishing identifiable individuals.

5.2 Publication on Our Website and Social Media

We may wish to use selected photographs, video excerpts and project references to demonstrate our professional work and promote our services through:

  • Our website and online portfolio.
  • Our professional social media accounts.
  • Business presentations and promotional materials.
  • Other professional channels relevant to our services.

Before publishing identifiable individuals, we assess the circumstances and legal basis for the intended use.

Depending on the circumstances, publication may be based on consent or another applicable legal basis, such as a properly assessed legitimate interest.

Our assessment may take into account:

  • The nature and purpose of the event.
  • Whether an individual is prominently featured or appears incidentally in a general event overview.
  • Whether the material includes an interview, close-up or focused recording.
  • The individual’s reasonable expectations.
  • The audience, context and potential impact of publication.
  • Contractual restrictions, confidentiality obligations and applicable image rights.

Where consent is required, we will obtain it before the relevant processing takes place.

Attendance at an event does not, by itself, constitute consent to every possible use of a photograph or recording.

5.3 Objections and Removal Requests

If you appear in a photograph or recording and have concerns about its use, you may contact us at production@slivki.nl.

We assess requests under the applicable data protection rules and the circumstances of the particular recording and publication.

A request does not automatically require the deletion of every related photograph, video, project file or publication. The GDPR establishes specific conditions for erasure and objection, and certain exceptions may apply.

Where the law requires us to stop processing or remove material, we will take the appropriate action.

Where we have overriding lawful grounds to continue processing, or a legal exception applies, we may retain or continue using the relevant material to the extent permitted by law.

We will not reject a legally valid request solely because the material has attracted views, engagement or promotional value.

Where material has been published by a client, event organiser or independent third party, we cannot guarantee removal of copies outside our control. Where appropriate, we will take reasonable steps within our control and inform the relevant party of the request.

We may request proportionate information to identify the relevant material and verify your identity where reasonably necessary.

Requests will be handled within the applicable statutory time limits.

6. Sharing Personal Data with Third Parties

We do not sell personal data.

Where necessary for the purposes described in this Privacy Statement, we may share personal data with the following categories of recipients:

  • Accountants and bookkeeping providers: for invoicing, accounting, tax reporting and financial administration.
  • Freelancers and subcontractors: where access to relevant information is necessary to perform a project.
  • Clients, agencies and event organisers: where necessary to coordinate services and deliver agreed materials.
  • Website hosting and IT providers: for website operation, maintenance and security. Our website is hosted by Hosting Ukraine (ukraine.com.ua).
  • Cloud storage and file-transfer providers: for storing, editing and delivering project files.
  • Communication and business software providers: for email, scheduling and project administration.
  • Professional advisers and public authorities: where disclosure is required by law or necessary to establish, exercise or defend legal claims.

We limit access to personal data to what is necessary for the relevant purpose.

Where a third party processes personal data on our behalf, we implement the contractual safeguards required by law, including a data processing agreement where necessary.

Some recipients may act as independent data controllers and process personal data under their own privacy notices.

7. International Data Transfers

Some service providers may store or process personal data outside the European Economic Area (EEA).

In particular, our website is hosted by Hosting Ukraine (ukraine.com.ua). The website and its server data, including information submitted through the contact form, are processed on servers located in Ukraine, which is outside the EEA. Backup copies are stored on servers in Germany.

Where personal data is transferred outside the EEA, we ensure that the transfer complies with applicable GDPR requirements.

Depending on the circumstances, safeguards may include:

  • An applicable European Commission adequacy decision.
  • The EU–US Data Privacy Framework, where the recipient is appropriately certified and the transfer falls within its scope.
  • Standard Contractual Clauses, together with any additional measures required by law.

Further information about applicable safeguards may be requested using the contact details in Section 2.

8. Data Retention

We retain personal data only for as long as necessary for the purposes for which it was collected, subject to applicable legal obligations and the need to establish, exercise or defend legal claims.

Retention periods depend on the type of data and the circumstances.

  • Business and contractual records: retained for the duration of the business relationship and afterwards where necessary for legal, contractual or administrative purposes.
  • Accounting and tax records: retained for the statutory period applicable to the relevant records. Under Dutch tax rules, core business administration records generally must be retained for at least seven years.
  • Enquiries and prospective business contacts: retained for as long as necessary to handle the enquiry and maintain a relevant professional relationship.
  • Supplier and subcontractor records: retained for the duration of the business relationship and afterwards where required for accounting, contractual or legal purposes.
  • Raw footage and project files: retained according to the project agreement, delivery and archiving arrangements, applicable client instructions and any legitimate need to establish or defend legal claims.
  • Portfolio photographs and videos: retained while their use remains necessary for the relevant purpose and a lawful basis continues to apply.
  • Website logs and cookie-related information: retained according to the technical requirements, website configuration and applicable service-provider settings.

We periodically review whether personal data remains necessary and securely delete or anonymise it when it is no longer required, unless further retention is legally required or otherwise permitted.

9. Your Rights Under the GDPR

Subject to the conditions established by the GDPR, you may have the right to:

  • Access: obtain confirmation of whether we process your personal data and request access to it.
  • Rectification: request correction of inaccurate or incomplete personal data.
  • Erasure: request deletion of personal data where the legal requirements are met.
  • Restriction: request restriction of processing in certain circumstances.
  • Data portability: receive certain personal data you provided to us in a structured, commonly used and machine-readable format where the legal requirements are met.
  • Object: object to processing based on legitimate interests on grounds relating to your particular situation.
  • Withdraw consent: where processing is based on consent, withdraw it at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
  • Object to direct marketing: object at any time to processing for direct marketing purposes. We will then stop using your personal data for that purpose.

These rights are subject to applicable legal conditions and exceptions. For example, certain records may need to be retained to comply with legal obligations or establish, exercise or defend legal claims.

To exercise your rights, contact production@slivki.nl and describe your request sufficiently for us to identify the relevant information.

We may request additional information where reasonably necessary to verify your identity, without requesting more information than necessary.

We normally respond within one month. Where permitted by law, this period may be extended by up to two additional months due to the complexity or number of requests. We will inform you of any extension and the reasons for it within the initial month.

If we refuse a request, we will provide the information required by law, including the applicable reasons and information about your right to lodge a complaint.

Our website is being developed using HTML, CSS, JavaScript and related web technologies.

Depending on the final configuration, the website may use cookies or similar technologies necessary for its operation, security, preferences, analytics or integrated third-party services.

The technologies actually used depend on the website’s source code, hosting configuration and external services.

Strictly necessary technologies may be used without prior consent where legally permitted.

Once the website is fully operational, this section will be reviewed to reflect the actual technologies in use.

11. Data Security

We take appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.

Access to business systems, project files and personal data is limited to persons who need it for legitimate business purposes.

Where subcontractors or external service providers require access, we seek to ensure that appropriate confidentiality and security obligations apply.

No method of electronic transmission or storage can be guaranteed to be completely secure. We nevertheless take reasonable steps to protect the information entrusted to us.
